Intellectual Property Registration of Industrial Design (India)

In India, the registration of industrial designs is governed by the Designs Act, 2000, and administered by the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM) under the Department for Promotion of Industry and Internal Trade (DPIIT). It involves:


Before filing an application, a thorough search is conducted by patent attorney, Kolkata (India) to ensure that your design is unique and not already registered or pending registration.

Preparation of Documents:

Filing Application:

Patent Attorney, Kolkata then completes the application of filing the design application with CGPDTM.


The filed design application then undergoes examination by CGPDTM for any deficiencies.


Once the application is found to be in order, it will be published Officially by CGPDTM which serves as notice to the public about your design and provides an opportunity for third parties to oppose the registration within a specified period.


If there are no oppositions or if they are successfully overcome, the design will be registered, and a certificate of Design registration is issued.


To maintain the registration, you must pay the renewal fee before the expiry of period.
