Viacom owns IP rights in every SpongeBob IP, and has recently sued Rusty Krab for using SpongeBob Square pants-theme for bar and restaurant. Interestingly, the Rusty Krab have been using names as names of their drinks like Pineapple Under the Sea, Bikini Bottom,Secret Formula, and I’m Ready. Though a disclaimer has been put up by Rusty Crab disclaiming any affiliation, association, authorization, endorsement by, or any sort of official connection with Nickelodeon or the SpongeBob brand directly, yet bit has attracted a case of deliberate infringement. Viacom have sued Rusty Krab for violation of viacom’s policy as SpongeBob IP is meant for kids while Rusty Krab is selling alcoholic beverages.
